What’s In A Name Is No Longer The Entire Question: The Rapid Evolution of NIL and The Right of Publicity
Presented by the Intellectual Property, Business, and Employment ISBA Sections
Wednesday, November 5, 2025 12:00 – 1:30 p.m. ET 1.5 hr. CLE About the event The introduction of Name, Image, and Likeness (NIL) allowances for amateur athletes has brought significant attention to the broader field of publicity rights. NIL is a subset of the Right of Publicity, yet both are frequently misunderstood and infringed upon in practice. This program will explore the current standards, authorities, and legal frameworks governing NIL and the Right of Publicity.
Because these issues extend beyond sports into industries such as film, television, music, and fashion, an understanding of NIL and publicity rights is relevant to nearly every legal practitioner. No prior knowledge of intellectual property law is required. Attendees will gain a practical awareness of NIL and the Right of Publicity, review landmark cases and recent legislation, and develop the ability to identify potential issues that could impact clients and help prevent costly mistakes.
