Eyewitness to Earwitness Testimony
In criminal cases, the government must prove identification of the accused. In some civil cases, a person’s identity may be an element in establishing who was or was not at fault. Eyewitness testimony can play a pivotal role.
This program discusses the errors of eyewitness identification, the 5 factors to challenge in a pretrial eyewitness identification lineup, tips in deposing eyewitnesses, and how to suppress eyewitness identification testimony. It will also explore earwitness testimony – what it is and how to challenge and suppress earwitness identification testimony.
