Sentencing Refresher: Key Considerations Before, During, and After a Trial

The sentencing process involves several distinct phases, each with its own key considerations. During the pre-trial phase, determining pre-trial jail time credit (JTC) is essential. As the case moves into sentencing and advising clients, attention must be given to credit classes, credit-restricted felons, and maintaining ethical standards. In the community corrections phase, providing clients with effective guidance on their options and responsibilities is crucial.
Following the trial, post-trial considerations include understanding IDOC policies on good time credit, exploring available programming, and knowing the procedures for filing modifications. Effective sentencing advocacy requires crafting compelling arguments for both the prosecution and defense while considering the judicial perspective. Additionally, special cases such as those involving juveniles or individuals with mental illness or substance abuse require tailored approaches to ensure fair and just outcomes.
