Garnishment of Social Security Benefits

Presented by the ISBA Pro Bono Committee

On-demand
1.0 hr. CLE

About the program

Social Security benefits are exempt from garnishment or attachment by most creditors. An important exception exists, however, when the creditor is a government agency. This presentation identifies the agencies which have the right to offset (garnish) a portion of Social Security benefits, the procedures the agency must follow, and the defenses or alternatives to offset available to Social Security recipients. The presentation also discusses which types of government debts can be discharged in bankruptcy, and provides a case example of how bankruptcy stopped a recipient’s benefits from being offset.

This session was presented as part of the 2022 "Talk to a Lawyer Today" prep course.

Presenter:

John E. Brengle, Indiana Legal Services
