Biased? Me? How Biology and Psychology Affect
our Opinions and Actions

And How to Recognize and Improve our Interpersonal Skills

Presented by LawPay as part of the 2020 ISBA Annual Meeting
On-demand

1.0 hr. CLE

About the event

So much of the practice of law involves decision-making, and convincing others to make better decisions based upon fact rather than emotion. This course is intended to guide attendees to appreciate how they involuntarily make decisions and guide them to recognize and prevent bias. We'll examine:
  • The biology of human decision-making, including emotion, mood, complex cognition, and reasoning
  • The psychology of decision-making, heuristics, and issue-framing
  • The seven steps to effective decision-making
  • Self-serving bias, confirmation bias, and epistemic closure
  • The backfire effect of receiving contradictory evidence
  • Crushing your insular cortex to relieve the stress of unacceptable truth
  • Justification and politicization
  • Tipping points to change misperceptions
  • Professional training received by judges
  • Strategies to prevent bias in your own decision-making
  • Strategies in communicating to third-parties

This session was presented as part of the ISBA Annual Meeting in October 2020.

Presenter:
Claude Ducloux, LawPay Director of Education, Ethics and State Compliance

Reviews from past participants

“Talented and entertaining presenter - broadly applicable material that is useful from the courtroom to the living room.”
“I think my hand hurts from how many notes I was taking for this particular CLE. The speaker was engaging and the topic was rich and complex. I'll definitely be keeping these notes for a long time.”
“This course is fantastic. It will help attorneys improve their performance in court by learning how jurors and judges think; it will help lawyers be better leaders in society; and it would help equip any viewer to be a more-informed citizen.”
“This was a greatly fascinating topic. I had never thought about many points he raised.”
“This is the best coverage of bias that I've seen. Great presentation!”
“This seminar helped me understand how people make decisions and why they stick to them in the absence of supporting facts.”
