About the event 

Registration is now open for ISBA's 2024 Associate Empowerment Series, an exclusive cohort of about 20 midlevel and senior women associates aimed at helping its members develop new strategies for success while building a network of support. Topics for the four-part series will be customized to meet specific needs of the cohort. Examples of possible topics include taking control of your practice and path forward, imposter syndrome, generating new business and clients, and positioning yourself for success. Sessions will be facilitated by experts in the legal community.

The goal is simple - create a safe place for you to learn from each other, share advice and develop your network of professional support.

About the program

Join the ISBA Pro Bono Committee in a challenge to clear as many questions as possible in Indiana Free Legal Answers' queue (and get access to a CLE bundle on common pro bono topics in the meantime).

Indiana Free Legal Answers—a virtual legal advice clinic answering Hoosiers’ civil legal questions at no cost—has over 150 questions in their queue. Join ISBA attorneys in the month of May to answer questions in a low-stakes environment, support Hoosiers, and brush up on consumer, housing/eviction, and divorce/custody issues.

Sharing their knowledge of the legal system is a form of community service unique to attorneys. Through pro bono, attorneys work directly with community members who may have no other means of legal recourse. In just a few minutes, attorneys can share counsel and resources that will make a lifetime of difference.

Volunteers who help clear the queue will receive this CLE bundle at a reduced price.

How It Works

Sign up for the CLE bundle and choose how many questions you commit to answering (3, 6, or 10). You will immediately receive links to view the on-demand CLE bundle.

Then, email Kim Latimore-Martin (klatimore-martin@inbar.org) that you have signed up to answer questions on Indiana Free Legal Answers. She will send you instructions on setting up an account and share a "Commonly Asked Questions" handbook with you (a guide that provides tips and information to help you answer questions in all areas of law).

We encourage you to take time on May 1 (Law Day) to visit the site and answer questions. But you have until May 31 to answer your committed questions.

This program will be of interest to legal professionals who want a refresher on common pro bono topics and want to support Hoosiers, but will be of particular interest to those who practice in family law, bankruptcy, and/or landlord tenant issues.

This 90-minute virtual presentation will look at the history of Stolen Valor, from Colonial times to today.   We will look at the Stolen Valor Act of 2005, the Strandlof and Alvarez decisions, the Stolen Valor Act of 2013 and the ensuing efforts of states to pass their own measures.  We will also look at how courts have dealt with the Defamation and Intentional Infliction of Emotional Stress cases that have been pressed against the “Stolen Valor Hunters.”

It’s no surprise that many of the clients served by traditional legal service providers are survivors of violence. Statistics are clear that there is a direct link between poverty and violence. For those of us working civil cases, understanding the traumatic impact of violence is critical to the quality of our representation. All lawyers and mediators, but especially legal service providers, should learn more about “trauma informed legal representation” and this seminar will introduce you to the concept. We have an obligation to learn the facts about the manifestation of trauma in our clients, and how we can, and indeed must, use that information to effectively litigate or mediate on their behalf.

This course will introduce and explain the proposed Guardian ad Litem (GAL) Guidelines, including:

  • Who may serve as a GAL (including criminal and DCS background checks)
  • The ongoing duty to notify GAL Family Law Oversight Committee (contrast this with their immunity)
  • Training requirements, annual continuing education requirements, and the courses/areas that fulfill the CE requirements
  • The GAL's role and responsibilities
    • GAL is a party to the case and may fully participate in all aspects of court proceedings—with or without counsel.
    • GAL shall advocate for child’s best interests at all stages of proceedings
    • GAL is independent 
    • GAL shall have in-person, direct, and sufficient contact with the child 
    • GAL must make a written or oral report to the court, to be filed min of 10 days before hearing unless waived by parties or good cause shown
    • If a child expresses wishes or desires pertaining to issues before the court, the GAL must convey these unless the child has expressed otherwise or conveyance would compromise safety Requirement of a Written Court Order—whether by agreement or court ordered
    • Order to contain name, duties, costs, duration and adherence to GAL guidelines and code of ethics
  • The duties of a GAL—to maintain best interest advocacy

Social Security benefits are exempt from garnishment or attachment by most creditors. An important exception exists, however, when the creditor is a government agency. This presentation identifies the agencies which have the right to offset (garnish) a portion of Social Security benefits, the procedures the agency must follow, and the defenses or alternatives to offset available to Social Security recipients. The presentation also discusses which types of government debts can be discharged in bankruptcy, and provides a case example of how bankruptcy stopped a recipient’s benefits from being offset.

About the program

Mediation through the services of a registered civil mediator with experience in employment law issues and litigation can be a very efficient and effective method for resolving employment law disputes, both prior to and subsequent to the commencement of litigation. In this seminar, we will present all aspects and best practices of the mediation process from the standpoint of all parties involved, including Plaintiffs, Defendants and the mediator. Special considerations that often apply to employment law cases will be addressed, including, but not limited to, the following:

  • The concern by Defendants in most areas of employment law that a judgment in favor of Plaintiff will result in the payment of all or a substantial portion of Plaintiff’s attorney fees.
  • The opportunity for mediation at an early stage, prior to litigation or prior to the complete litigation discovery process. 
  • The high standard for Plaintiff’s burden of proof in certain cases requiring “but-for causation."
  • Case evaluation in respect to the filing of Summary Judgment on all or a portion of Plaintiff’s claim.
  • The extent to which a Plaintiff and, in many cases, the Defendant may be emotionally invested in the outcome of the case and how this may affect the mediation process.
  • The consideration of the cost of defense by Defendant and, in the usual case of a contingent fee arrangement, the time and expense incurred by Plaintiff’s counsel, as well as the potential payment of costs by Plaintiff in the event of a defense verdict. 

The issues and concerns that often arise in the settlement of employment law cases will be discussed, as well as the mediation process in general.

Since March 2020, COVID-19 has brought more change to the legal profession in the past four months than in the past decade.  Yet many lawyers still view changes such as working from home, online depositions and virtual client meetings as a temporary measure, and that the legal profession will return to normal.  That, however, would be a mistake. 

Even in this short timeframe, lawyers and staff have adapted to working from home, and clients have become accustomed to meeting with lawyers and other professionals online – and will still desire the same even when the pandemic is under control. A movement in the U.S. is slowly modernizing state HIV-specific criminal laws to bring them in line with current medical science and best criminal justice practices. Indiana has several HIV criminal laws (some also criminalize viral hepatitis). This seminar examines HIV criminalization and laws, why it’s a problem, and what is being done to modernize the law using Indiana as a case example.  

Carrie FooteSpeaker: Dr. Carrie Foote (she/her): Is a professor of Sociology at IUPUI with expertise in HIV criminal law reform.  She contracted HIV from injection drug use in 1988 and leads Indiana’s HIV Modernization Movement to end HIV criminalization.

Evictions became a central focus during the COVID-19 pandemic. Both the state of Indiana and the federal government issued a number of eviction moratoria throughout the past year, most of which will expire on June 30, 2021. In response to the looming eviction crisis, state and local bar associations, as well as the Indiana Supreme Court, implemented a number of resources and pro bono clinics to address the need of vulnerable Hoosier tenants.

This training will provide a detailed discussion of the various tenant protections issued over the past year, highlight continuing tenant protections, and equip advocates with strategies in working with tenants in a pro bono setting. Attendees will hear on-the-ground stories from tenant advocates and judicial officers to learn about current issues and best practices regarding evictions in the state of Indiana.

We’re seeking curious attorneys who would consider volunteering through either: (1) offering brief housing advice or (2) representing a tenant in court with supervision from an experienced civil legal aid attorney.

About the event

This session covers topics related to Children in Need of Services (CHINS). This overview includes potential components of a CHINS case, including (but not limited to) types of participants, investigation, removal, hearings, case plans, and placement.

This session was presented as part of the 2021 "Talk to a Lawyer Today" prep course.
