<title>Gary Probate Division of Lake Superior Court permanently closes</title>

<description><![CDATA[<span style="font-size: 14px;"><span style="font-size: 14px;"></span><span style="font-size: 14px;">All probate files that were opened in Lake Superior Court in Gary have been physically transferred to the Crown Point Probate Division, according to America L. </span><span style="font-size: 14px;">McAlpin</span><span style="font-size: 14px;">, Probate Commissioner, Lake Superior Court. Any attorneys who may have filed cases, at any time in the past, in the Gary Probate Division should take note.</span> </span>
<p><span style="font-size: 14px;">&nbsp;</span></p>
<p><span style="font-size: 14px;">The Probate Division cases that were filed in the Gary location would have cause numbers that begin with “45D03” or “45D04”; files on all of those cases are now being reviewed and sorted by Commissioner </span><span style="font-size: 14px;">McAlpin</span><span style="font-size: 14px;">’s staff and that of Courtroom 7 for transfer to the Crown Point Probate Division as active files or for their closure, dismissal or other appropriate disposition.</span></p>

<title>ISBA legislative wrap-up</title>

<description><![CDATA[<p><span style="font-family: Verdana; font-size: 14px;">The 2018 Indiana General Assembly adjourned mid-March but is likely to return to the Statehouse next month for a special session at the request of Gov. Holcomb to tie up some loose ends. Despite the Legislature’s unfinished business, the Indiana State Bar Association had a successful year with several bills promoted by our sections passing. </span></p>
<p><span style="font-family: Verdana; font-size: 14px;">&nbsp;</span></p>
<p><span style="font-family: Verdana; font-size: 14px;">Not adopted during the final hours of the legislative session was <a href="http://iga.in.gov/legislative/2018/bills/house/1316">HB 1316</a>, Indiana’s response to the Federal Tax Reform legislation. Because of this inaction, all businesses will have to calculate federal adjusted gross income tax twice to comply with state and federal tax laws (unless the proposed special session passes the bill).</span></p>
<p><span style="font-family: Verdana; font-size: 14px;">&nbsp;</span></p>
<p><span style="font-family: Verdana; font-size: 14px;">We’re sad to report that four great lawyer-legislators will not be returning to the Statehouse. Sen. David C. Long announced his impending retirement as did Rep. Thomas W. Washburne. And right before the session began Senators Luke Kenley and Brandt Hershman retired. The ISBA is grateful for their longtime service to the citizens of Indiana. </span></p>

Amends the Indiana Code provision concerning the establishment of property lines by means of a legal survey to: (1) eliminate the exception to the required notice when all adjoining landowners consent in writing; and (2) specify that the lines established are binding on all affected landowners. Defines "original survey". Defines "retracement survey". Provides that, other than for descriptions of lots in new subdivisions, any new or modified real property description prepared by a professional surveyor as a product of an original survey or a retracement survey must include a caption that identifies: (1) the name and registration number of the professional surveyor preparing the description; and (2) the plat of survey produced as part of the original survey or retracement survey, including certain specified information. Be sure to read <a id="Trial Rule 86" href="http://www.in.gov/judiciary/rules/trial_proc/index.html"><span style="color: #0b4cb4; text-decoration: none;">Trial Rule 86</span></a> in its entirety, and especially Rule 86(G)(2) regarding service of an initial filing.</span></p>

<title>U.S. District Court for the Southern District of Indiana announces new chief judge</title>

<description><![CDATA[<span style="font-family: Verdana;">INDIANAPOLIS, Indiana (November 28, 2016): On Wednesday, November 23, 2016, the United States District Court for the Southern District of Indiana came under the leadership of a new chief judge, the Honorable Jane E. Magnus-Stinson. She assumed this position upon the expiration of Judge Richard L. Young’s term as chief judge.<br />
<br />
Chief Judge Magnus-Stinson received her commission as district judge for the Southern District of Indiana on June 9, 2010, filling a vacancy created by Judge Larry J. McKinney’s assumption of senior status on July 4, 2009. Before becoming a district judge, Chief Judge Magnus-Stinson served the Southern District of Indiana as a magistrate judge from 2007 until her elevation. Prior to that, from 1995-2007, she was a judge on the Marion County Superior Court. Chief Judge Magnus-Stinson is a graduate of Butler University and the Indiana University McKinney School of Law.<br />
<br />
Chief Judge Magnus-Stinson currently serves on the Defender Services Committee of the Judicial Conference of the United States, the Seventh Circuit Criminal Pattern Jury Instructions Committee, the Seventh Circuit Advisory Committee on Rules, and the Seventh Circuit Committee on Supervised Release.&nbsp; She has served as Chair of the Facility/Court Security Committee for the Southern District of Indiana since 2010.<br />
<br />
During Judge Young’s seven-year term as chief judge, the court welcomed two new district judges (Judge Magnus-Stinson and Judge Tanya Walton Pratt) and four new magistrate judges (Mark J. Dinsmore, Denise K. LaRue, Matthew P. Brookman, and Van T. Willis). During that same time, Judge Sarah Evans Barker assumed senior status, a vacancy that remains unfilled. Also during Judge Young’s time as chief judge, the court closed more than 24,500 civil and criminal cases, placing the Southern District of Indiana 6th in the nation by weighted caseload.<br />
<br />
Judge Young provided the court with valuable leadership during his tenure. Under his direction, the court moved to a paperless filing system, except in miscellaneous cases; initiated a prisoner e-filing system that is now in use at eight different detention facilities; operated without interruption during a government shutdown and numerous continuing resolutions; instituted the ability for attorneys to file new cases electronically; and transitioned to a new financial management system. Additionally, for a significant portion of Judge Young’s term as chief judge, the Birch Bayh Federal Building and United States Courthouse was under renovation, necessitating courtroom sharing and multiple moves by the judges and court staff.<br />
<br />
The position of chief judge is assigned based on length of service, and is given to the judge in regular active service who is senior in commission of those judges who are (1) 64 years of age or under; (2) have served for one year or more as a judge; and (3) have not previously served as chief judge. The chief judge serves for a term of seven years and handles administrative matters related to the operation of the clerk’s office and the courthouse that do not require the attention of all the judges. The chief judge carries a full caseload in addition to these administrative duties and does not receive any additional pay.<br />

Provides that the administrator of the ELTF: (1) shall pay claims according to a certain priority payment system if the balance in the ELTF drops below $25,000,000; and (2) shall cease paying claims if the balance in the ELTF becomes insufficient to pay ELTF claims and necessary personnel and administrative expenses. Prohibits the administrator of the ELTF from paying: (1) more than $2,500,000 from the ELTF per eligible release; or (2) more than $10,000,000 from the ELTF per fiscal year. Provides that the total amount otherwise available from the ELTF in connection with an eligible release shall be reduced by a "deductible amount" of $15,000 and, if applicable, the sum of: (1) all annual registration fees for underground storage tanks (USTs) located at the site of the eligible release that were due in 1991 or later and not paid in the year they were due; and (2) an additional $1,000 for each UST annual registration fee not paid in the year it was due. Revises provisions concerning the procedure for submitting and paying claims for payment from the ELTF. Provides that a court may grant a guardian access to the digital assets of the protected person and that, under certain circumstances, a custodian is required to disclose to a guardian a catalogue of electronic communications sent or received by the protected person. Authorizes a fiduciary of a user to request that a custodian terminate the user's account. Provides that, if the conditions for compliance are met, a custodian must comply with a request from a fiduciary to disclose digital assets or terminate an account within 60 days, and if the custodian fails to comply with the request, the fiduciary may apply for a court order directing compliance. Provides that the legal duties imposed on a fiduciary charged with managing tangible property also apply to a fiduciary charged with managing digital assets. Amends the law on unsupervised administration of a decedent's estate to provide that a distributee has the same rights as a personal representative to access the digital assets of the decedent. Provides that if an owner of property that has been sold at a tax sale sells the property during the redemption period: (1) the amount the buyer must pay to redeem the property includes any excess amount that was paid by the winner bidder at the tax sale and that is being held in the tax sale surplus fund; (2) a county recorder may not record the conveyance document unless the buyer has redeemed the property; and (3) if the buyer does not redeem the property before the end of the redemption period, the conveyance is inoperable and void. Gives the attorney general the power to enforce current law pertaining to agreements for compensation to locate, deliver, recover, or assist in the recovery of money deposited in a tax sale surplus fund with respect to real property as a result of a tax sale. Provides that when a governmental entity or the state becomes the owner of real property with unpaid property taxes, delinquencies, fees, special assessments, and penalties assessed against the real property, the department of local government finance may release the lien against the real property and cancel these assessments with respect to the governmental entity, the state, or a subsequent purchaser, regardless of whether the property taxes were assessed before or after the governmental entity or the state became the owner of the real property. <title>Valpo invited to Oxford for moot court competition this week</title>

<description><![CDATA[<span style="font-size: 14px;">This year the Valparaiso University School of Law International Moot Court Society (<a href="www.valpo.edu/law/current-students/student-organizations/international-moot-court"><strong>www.valpo.edu/law/current-students/student-organizations/international-moot-court</strong></a>) has been invited to compete at the University of Oxford. Known for being notoriously selective, the Oxford opportunity is only offered to teams that earn an invitation. In nine years since the inception of Valpo’s Moot Court Society, this year’s team was the first to receive an invitation. To earn this invitation, our team competed in the Monroe E. Price Media Law Moot Court Competition at the Cardozo School of Law in New York City. Preparing for the competition required diligent research of international law that concerned the topic of media law. This year’s topic involved the promotion and maintenance of freedom of expression when it confronts hate speech and anti-terrorism laws. In a world confronted with terrorism on social media, countries have found themselves in a bind when meeting the international duty against terrorism and maintaining freedom of expression. Here, the team found several similar laws in various countries internationally and domestically. </span>
<p class=""><span style="font-size: 14px;">&nbsp;</span></p>
<p class=""><span style="font-size: 14px;">The Price Media Law fact pattern involved a fictional country that passed two separate statutes aimed at defeating hate speech and terrorism. Within the fact pattern, a fictional politician, who was employed as a justice within the state, published posts on social media that were viewed as incitement of violence to some and satire to others. Here, the state dealt with imminent ethnic violence at the hands of a terrorist group that shared the underlying message the politician attempted to convey.</span></p>
<p class=""><span style="font-size: 14px;">&nbsp;</span></p>
<p class=""><span style="font-size: 14px;">This fact pattern is highly reflective of current events involving the encouragement of terrorism on social media sites such as Twitter. Presently, ISIS has taken to these channels to promote an anti-Western agenda that includes broadcasts of executions. Most notable was the James Foley incident where a masked individual executed an American journalist. Here, it was determined that the masked executioner had a British accent. As a direct result of this, countries such as the United Kingdom and the United States have examined ways to address the encouragement of terrorism. </span></p>
<p class=""><span style="font-size: 14px;">&nbsp;</span></p>
<p class=""><span style="font-size: 14px;">Internationally, member states under the United Nations look to the International Covenant on Civil &amp; Political Rights (ICCPR) and the Universal Declaration of Human Rights (UDHR) for guidance on maintaining the civil rights and safety of their citizens. The ICCPR and UDHR both shed light on the freedom of expression as a universal right. However, this right is not absolute and may be limited when confronted with a legitimate interest. Also important to these two universal documents is the right of privacy. Here, no individual may be subject to arbitrary interference with his or her personal privacy.</span></p>
<p class=""><span style="font-size: 14px;">&nbsp;</span></p>
<p class=""><span style="font-size: 14px;">Laws in Denmark, the United Kingdom and the United States are highly reflective of the fictional No Hate Law and the Anti-Terrorism &amp; Extremism Law. Here, the team dissected case law focused on these laws, which showed how a functioning society could address legitimate interests, in a practical way, by passing and enforcing such laws. By cooperating with United Nations documents, the fictional laws are in turn binding on state parties to the UN Charter. For this reason, the argument advanced by our team is hard to defeat.</span></p>
<p class=""><span style="font-size: 14px;">&nbsp;</span></p>
<p class=""><span style="font-size: 14px;">It is the team’s goal to return to the competition at the University of Oxford and advance as we had done in the Americas regional tournament (<a href="http://pricemootcourt.socleg.ox.ac.uk/2016/02/americas-regional-rounds-in-new-york-completed"><strong>http://pricemootcourt.socleg.ox.ac.uk/2016/02/americas-regional-rounds-in-new-york-completed</strong></a>). The international rounds will take place March 30 through April 2. <p class=""><span style="font-family: Verdana; font-size: 12px;">&nbsp;</span></p>
<p class=""><span style="font-family: Verdana; font-size: 12px;">The duties of the position are demanding and wide-ranging: conduct of most preliminary proceedings in criminal cases; trial and disposition of misdemeanor cases; conduct of various pretrial matters and evidentiary proceedings on delegation from a district judge; and trial and disposition of civil cases upon consent of the litigants. The basic jurisdiction of a United States magistrate judge is specified in 28 U.S.C. §636.</span></p>
<p class=""><span style="font-family: Verdana; font-size: 12px;">&nbsp;</span></p>
<p class=""><span style="font-family: Verdana; font-size: 12px;">To be qualified for appointment an applicant must:</span></p>

<p class=""><span style="font-family: Verdana; font-size: 12px;"><strong>1)</strong> Be, and have been for at least five years, a member in good standing of the bar of the highest court of a state, the District of Columbia, the Commonwealth of Puerto Rico, the Territory of Guam, the Commonwealth of the Northern Mariana Islands, or the Virgin Islands of the United States, and have been engaged in the active practice of law for a period of at least five years (with some substitutes authorized);</span></p>

<p class=""><span style="font-family: Verdana; font-size: 12px;"><strong>2)</strong> Be competent to perform all the duties of the office; be of good moral character; be emotionally stable and mature; be committed to equal justice under the law; be in good health; be patient and courteous; and be capable of deliberation and decisiveness;</span></p>

<p class=""><span style="font-family: Verdana; font-size: 12px;">A merit selection panel composed of attorneys and other members of the community will review all applications and recommend to the district judges in confidence the five persons it considers best qualified. The court will make the appointment following an FBI full-field investigation and an IRS tax check of the applicant selected by the court for appointment. The individual selected must comply with the financial disclosure requirements pursuant to the Ethics in Government Act of 1978, Pub. L. No. 95-521, 90 Stat. 1824 (1978) (codified at 5 U.S.C. app. 4 §§ 101-111) as implemented by the Judicial Conference of the United States. An affirmative effort will be made to give due consideration to all qualified applicants without regard to race, color, age (40 and over), gender, religion, national origin, or disability. The current annual salary of the position is $185,012. The term of office is eight years.</span></p>

The Indiana Court of Appeals has adopted a new, reader-friendly format for all opinions and orders, effective Jan. 26.<br>
&nbsp;<br>
The format employs a new, larger typeface (Calisto MT); paragraph numbering for easy reference; ragged-right copy justification; and line spaces instead of indents to mark new paragraphs.<br>
&nbsp;<br>
The changes are based on typography industry best practices and are meant to optimize both print and online reading experiences. The new format is also more useful for optical character recognition, which is used to make scanned documents searchable.<br>
&nbsp;<br>
