It is my honor to chair the Environmental Law Section of the Indiana State Bar Association this year. We are planning a number of exciting events in the coming months, including a summer CLE event and rooftop reception next week, July 9, at the 5th Floor Regions Conference Center located in downtown Indianapolis (One Indiana Square). The two-hour CLE program will begin at 3 p.m., immediately followed by a reception sponsored by Wilcox Environmental Engineering. Click here to register today.


Also, please mark your calendars now for the State Bar's 119th Annual Meeting in French Lick, where we will host our annual section meeting on Oct. 8. Details and registration information for the Annual Meeting will be available soon. You can also look forward to our holiday party held in conjunction with the Indianapolis Bar Association Environmental Law Section this coming December. Please note: We usually send out email blasts to section members with information regarding these events. If you have not been receiving our emails and would like to, please send an email to Barb Whaley at to make sure you don’t miss out.

Our newsletter editor, Jennifer Baker, has put together an issue packed with useful information for our members. David Gillay updates us on the ASTM standards for environmental due diligence and US EPA’s promulgated final rule amending the standards and practices for conducting All Appropriate Inquiry. Those of us who regularly help clients transfer, develop, or otherwise deal with real estate, especially brownfields, will want to pay careful attention. The Hon. Catherine Gibbs gives us an overview of several discovery issues that the Office of Environmental Adjudication has dealt with in the past few years. Finally, we review the Mounds Lake Project, which may help solve water shortages in the next 15-35 years for portions of central Indiana. I thank all of our writers for donating their time and skills to educate our members and Jennifer Baker for her diligence and hard work in soliciting and shepherding the newsletter along.

A number of you have asked whether we will be producing the annual environmental statute books. We have not made a decision on that yet. The books are costly to put together. However, we strive to be of service to our members, so if the statute book is something you rely on, we want to continue providing this service. If you would like this section to continue producing the statute books and think that you would purchase the book, please let us know.

Finally, I encourage you all to get involved with this section. If you have ideas regarding future CLE programs or articles for upcoming newsletters, please feel free to contact me or any of the other current officers or section committee leaders: Kim Ferraro, David Pippen, Sean Hirschten, H. Max Kelln, Dan Cory, Carrie Doehrmann, Tom Baker, Gus Hawkins, or Amy Romig. In addition, we are always looking for fresh faces and new voices to help run this section. If you are interested in taking on a leadership position, please do not hesitate to let us know. I hope to see all of you at our various events this coming year.
