This seminar will examine the holding in Brunetti, which invalidated the Scandalous and Immoral Clauses of Section 2(a) of the Lanham. What will be the consequences of the decision, and what are the implications for other provisions of the Lanham Act? What is the status of similar provisions in other countries?

Vice Judge Janet Gongola, Vice Chief Judge for Engagement at The Patent Trial and Appeal Board (PTAB), United States Patent and Trademark Office
Judge Gongola will speak on the new process for issuing precedent at the PTAB, with a focus on recent decisions issued under the new process. She will also provide an update on the Trial Practice Guide, discussing new procedures such as the new motion to amend pilot program and the handling of multiple petitions, both serial and simultaneous.
