This program is an interactive conversation about effective administrative adjudication procedures for practice before Indiana’s two environmental administrative adjudication agencies:  Natural Resources Commission (NRC) and the Office of Environmental Adjudication (OEA). The conversation will be facilitated by Indiana’s four environmental administrative law judges.  We will be discussing effective procedures for different stages of administrative adjudication practice: from pre-hearing practice, including discovery and dispositive motions, mediation, to the hearing and judicial review.  The administrative adjudicators anticipate a lively discussion about the effectiveness of current procedures and how procedures should be modified to improve meeting your client’s goals.  The conversation will also include input from you about how practice before NRC and OEA may benefit from procedures/trends in other forums.  Gov. Eric J. Holcomb’s Deputy General Counsel Cynthia Carrasco will join us to address your questions about how Indiana is striving to assure the professionalism of administrative adjudication, including her efforts during her tenure as Inspector General to explore effective ethical parameters for ALJs, which efforts inform the developing Office of Administrative Proceedings created in HB 1223 (from which NRC and OEA are exempt).


Other current topics will also include:

  • electronic filing and docketing
  • case management techniques to streamline achievement of a fair result
  • corporate representation
  • discrepancies in Indiana’s statutes and administrative rules concerning mediation.
