5th Annual Litigation Symposium

August 22, 2019

9:00 a.m. – 4:30 p.m.

6.0 hrs. CLE

Emory University School of Law Professor Timothy P. Terrell is back with new material:

"Advanced Writing & Editing: Beyond Logic to Coherence & Strength"

The legal writing program presented by Prof. Terrell is unusual: It is not limited to details of grammar or isolated “tips” that might improve a document. It is instead much more ambitious. The program identifies and develops fundamental writing principles (not “rules”) that define effective written communication more generally – not just in English, but in any language.

The purpose of the program is to build a “common writing vocabulary” within any legal organization that helps its lawyers produce excellent documents more efficiently. Busy law offices everywhere face a characteristic problem that few address: Even though all of them have excellent writers within them, none of these lawyers know why they are excellent writers. They are therefore unable to communicate their skill to others effectively. The program is intended to fill that gap and demonstrate the distinction between “thinking like a lawyer,” which law school emphasizes, and “thinking like a writer,” which law practice demands.

The program will begin with a description of the writing principles from which all other, more particular, guidance will be derived. It starts by analyzing the appropriate “macro” structure of effective documents – briefs, internal firm memoranda, letters to clients, and so on – and progresses toward more “micro” issues of paragraph and sentence structure. It demonstrates the power of the basic principles through numerous examples and occasional exercises discussed with the audience.
