Welcome to the Spring 2004 edition of the Out-of-Court Reporter. With the CLE program at the Spring Meeting concentrating on the area of Family Mediation, this issue of the newsletter features several short articles from one of our members, Janet Mitchell, who practices in this area of ADR in Allen County. Affording Divorce Mediation:

Effective July 1, 2003, all 92 counties may provide assistance to low-income domestic relations litigants. In paternity, separation and dissolution cases, IC 33-4-13 sets up a system for counties to adopt which would link parties' co-payments to income.

Judges Serving as Mediators:

The ADR Rule 2.5 was changed to permit judges to mediate in cases pending before another judge, a practice now being done in Allen County where many judges have mediation training. This applies to both civil cases per 2.5(A)(5) and domestic relations cases per 2.5(B)(5).

Potpourri
Mediation in the domestic area is not only for divorce and custody situations. ADR and mediation in particular can also be used for dealing with eldercare issues.

Janet Mitchell, an Eldercare Mediator, has written a short article entitled Eldercare Family Decisionmaking Mediation: A Better Way to Make Decisions, which outlines the advantages of mediation when caring and making decisions for elderly relatives.

Janet has also been kind enough to provide a short article addressing Transformative and Facilitative Mediation.
